Terms of Reference
 

Introduction

Hong Kong Mediation Accreditation Association Limited ("HKMAAL") is established subject to the Memorandum and Articles of Association of the Hong Kong Mediation Accreditation Association Limited.


1. Aims
The aims of the HKMAAL are:

  • To set standards for accredited mediators, supervisors, assessors, trainers, coaches and other professionals involved in mediation in Hong Kong, and to accredit them on satisfying the requisite standards.
  • To set standards for relevant mediation training courses in Hong Kong, and to approve them on satisfying the requisite standards.
  • To promote a culture of best practice and professionalism in mediation in Hong Kong.


2. Council

2.1 The Council shall consists of not more than 10 Council Members, including:

  • a person appointed by The Law Society of Hong Kong;
  • a person appointed by Hong Kong Bar Association;
  • a person appointed by Hong Kong International Arbitration Centre;
  • a person appointed by Hong Kong Mediation Centre;
  • not more than 4 other persons elected by Members; and
  • Not more than two persons appointed by the Council from outside the membership on such terms as the Council shall determine.

2.2 Provided that any person appointed to the Council pursuant to Article 2.1(i) to (iv) shall be a representative of only that respective Member, notwithstanding such person shall be eligible to represent any other member.

2.3 The Council may appoint committees or form special interest groups or working parties for special purposes with such powers as it may prescribe.

2.4 The quorum required for determining business transactions of the Council is half.

Other than as provided for in these Terms of Reference, the Committee shall organize its meetings from time to time as it shall see fit.


3. Status of These Terms of Reference

In the event of any discrepancy between the Memorandum and Articles of Association of HKMAAL and these Terms of Reference or any amendment thereto, precedence shall be given to the Memorandum and Articles of Association of HKMAAL.
